Rental Agreement

DEFINITIONS. "Agreement" means all terms and conditions found on both sides of this form, any addenda or any additional materials we provide at the time of rental. "You" or "your" means the person identified as the "renter" under "Client Information" on Page 1, any person signing this agreement, any authorized Driver and any person or organization to whom charges are billed by us on the renter's direction. All persons referred to as "you" or "your" are jointly and severally bound by this agreement. "We," "our" or "us" means VELOCITY RENTALS LLC, a Minnesota limited liability company, dba VELOCITY Luxury and Classic Rentals, the Rental Agent identified at the top of Page 1. "Authorized Driver" means you, any additional driver approved by us and listed by us on this agreement, and any other driver authorized by the law of the state where the Vehicle is rented provided that person has a valid driver's license and, unless the law of this state requires otherwise, is at least twenty-five (23) years of age. "Vehicle" means the automobile identified in this agreement and any substitute and all its tires, tools, accessories, keys, equipment, keys, and Vehicle documents. "Physical damage" means all damage to, or loss of, the Vehicle caused by collision or upset; it does not include damage to, or loss of the Vehicle due to theft, vandalism, act of nature, riot or civil disturbance, hail, flood, or fire. "Loss of use" means the amount calculated by multiplying the number of days/weeks/months from the date of damages to the Vehicle until it is repaired times the corresponding periodic rental rate, unless otherwise provided by law.

RENTAL. This agreement is a contract for the rental of the Vehicle. WE MAKE NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT REGARDING THE VEHICLE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR THAT THE VEHICLE IS FIT FOR A PARTICULAR PURPOSE. We may repossess the Vehicle at your expense without notice to you, if the Vehicle is abandoned or used in violation of law or this agreement. You waive all recourse against us for any criminal reports or prosecutions that we take against you that arise out of your breach of this agreement.

CONDITION AND RETURN OF VEHICLE. You must return the Vehicle to our rental office or other location we specify on the date and time specified in this agreement and in the condition that you received it, except for ordinary wear. Service to the Vehicle or replacement of parts or accessories during the rental is prohibited. You will check and maintain all fluid levels.

RESPONSIBILITY FOR DAMAGE OR LOSS; REPORTING TO POLICE. You are responsible for all damage to or loss of the Vehicle, loss of use of the Vehicle while it is being repaired, diminution of the Vehicle's value caused by damage to it or repair of it, missing equipment, and all administrative costs we incur due to damage to, or loss of, the Vehicle regardless of whether or not you are at fault, unless this responsibility is otherwise limited by law. You must report all accidents or incidents of theft and vandalism to the police as soon as you discover them. You must report all accidents involving the Vehicle to us immediately following making a police report.

DRIVER, AGE, AND ADDITIONAL AUTHORIZED DRIVERS. All drivers must be 23 years of age with a valid drivers license with a Young Driver’s option for Two Hundred Dollars ($200.00) allowing drivers as young as 21. Only drivers listed on the rental agreement are allowed to drive and operate the vehicle. Additional drivers must be listed and paid for before rental pickup. All additional drivers listed are required to have a valid drivers license and meet the applicable age requirements. Breaking the age or authorized additional drivers policy will result in a forfeit of any deposit, or a Five Hundred Dollar ($500.00) fee charged to your credit card.

LATE RETURN FEE. There is a thirty minute grace period for being late on a return. After thirty minutes there is a Two hundred dollar ($200.00) late fee charged, followed by an additional One hundred dollars ($100.00) applied for each additional thirty minutes the vehicle is late to be returned.

INSURANCE. You affirm and acknowledge that the condition of the Vehicle under this Agreement is excellent without any defects to the interior, exterior or engine of the Vehicle at the time of rental. Any minor cosmetic details or damages has been identified and described in the agreement details prior to the rental. You hereby agree that you shall follow all terms of this Agreement and are fully liable for any damage, changes or alterations to the condition to the Vehicle upon its return and shall be subject to coverage for liability under any of the applicable insurance policy(s).

You affirm and state that you are a lawfully licensed and valid driver and have a current and valid insurance policy with minimum liability limits of 100/175/100 AND collision coverage of $250,000 AND minimum of $40,000 in no fault coverage for any auto related incidents. You agree that you are responsible for all damages or losses you cause to others, yourself and/or the Vehicle. You will indemnify, defend, and hold us harmless from all liability, costs and attorney fees arising out of use of the Vehicle. The parties agree that this agreement shall be subject to the Graves Amendment to vicarious liability and all other applicable local, state and federal laws.

You agree to provide auto insurance covering you, us, and the Vehicle. OR that you have selected and purchased our Renter's Liability Insurance & Comprehensive Collision Damage Warranty option (RLCCDW).

Renter's Liability Insurance & Comprehensive Collision Damage Warranty option (RLCCDW). You acknowledge that if this option is selected the Vehicle will have liability and collision damage coverage meeting both state minimum requirements and coverage requirements for the Vehicle. You will not be required to provide proof of personal liability or collision insurance if this option is selected and paid for. Third-party liability coverage only. Subject to a $1,000 deductible per covered loss. Protects against costs arising from damage to the rental Vehicle itself, such as collision, theft, or vandalism (Coverages under this policy: 3rd-party Liability of $130,000/$200,000/$110,000. No-fault coverage $75,000, Comprehensive and collision damage warranty coverage is $250,000.) Not available on all vehicles. Subject to change.

SMOKING. You agree not to smoke or vape inside a velocity vehicle. We are able to know without a smell as our fleet has smoke and vape detection inside. There is a $750 cleaning fee that will be charged to the method of payment used if the vehicle is found to have been smoked or vaped in.

CLEANING & EXCESSIVE MESS POLICY. If a velocity vehicle is returned dirty or soiled to the point of needing to come out of service, this will be considered excessively messy and a $250 cleaning fee will be charged to the method of payment used. This includes but is not limited to; mud, dirt, sand, food spills, liquid spills, or strong odors.

If a vehicle has any of the following there will be an Excessive Mess Cleaning Fee of $750.00 and result in a lifetime ban on renting.

Vomit
Feces
Bodily Fluids
Blood
Illegal Substances

CHARGES. You will pay us on demand for all charges due under this Agreement that are allowed by law, including, but not limited to: (a) time and usage for the period during which you keep the Vehicle; (b) charges for optional services, if you elect to purchase any; (c) applicable sales use and other taxes; (d) loss of, or damage to the Vehicle, which is included in the cost of repair of the retail value of the Vehicle based on valuation methods accepted by the auto insurance industry on the date of the loss if the Vehicle is not repairable, plus loss of use, diminution of the Vehicle's value caused by damage to it or repair to it, and our administrative fees incurred for processing the claim; (e) all fines, penalties, forfeitures, court costs, towing charges and other expenses involving the Vehicle assessed against us or the Vehicle during your rental, unless these expenses are our fault; (f) all expenses we incur in locating and recovering the Vehicle if you fail to return it or we elect to repossess the Vehicle under the terms of this Agreement; (g) all costs, including pre and post judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this agreement; (h) Five hundred dollars ($500.00) plus Five dollars ($5.00) per mile between the renting location and place where the Vehicle is left or abandoned, plus any additional recovery expenses we incur, and (i) Fifty dollars ($50.00) per hour should the Vehicle return after the agreed upon time with no prior communication (j) Five hundred dollars ($500.00) if the Vehicle keys are lost or stolen. (k) Five hundred dollars ($500.00) if a selected shield safety seat is not returned. (l) Market Rate times the gallons needed for fuel if the Vehicle is not returned with a full tank AND the prepaid fuel add-on was not purchased. We will charge your card on file for any of these charges if warranted.

REFUND POLICY. A full refund will be issued on cancellations made 72 hours or more before the reservation start time. If a cancellation is made within 72 hours of the reservation start, then a credit will be issued to you to use on a future reservation. There is no refund given within 72 hours of your reservation start. There are no pro-rated refunds given if you are needing to cut your reservation short. Depending on length, a credit may be given for future use. This policy does not apply if you selected the Total Trip Protection Package at the time of booking. REFUNDS ARE NOT GIVEN IF THE BOOKING IS MADE AND THE DRIVER IS UNDER THE AGE OF 21 YEARS OLD. IT IS THE RESPONSIBILITY OF THE RENTER AND DRIVER(S) TO BE ELIGIBLE AT THE TIME OF BOOKING.

DEPOSIT. You will provide a security deposit of Two Thousand Dollars ($2,000.00). We may use your deposit to pay any damages or late fees owed to us under this agreement or for a breach of this agreement. Deposits are waived if you select and pay for the Total Trip Protection Coverage. A Credit Card in the name of the renter is still required to book.

ADD-ONS /SELECTED OPTIONS. This applies to all options selected and added onto the rental. You agree to pay and fulfil these requirements. On physical items you assume responsibility for the return of the item in clean condition free of damage or modifications.

CHILD SEATS: We follow a strict inspection and sanitization process with our car seats giving you security and peace of mind. You agree to return the Child Seat in complete undamaged condition. Velocity employees are not allowed to install the child seat. Theft or damage to a Child Seat will result in a $500.00 fee.
PRE-PAID FUEL: There is no refund or credit given if the car is returned full or not. This selection is final and allows no requirement for fuel level on return.
24/7/365 ELITE ROADSIDE CONCIERGE: Coverage for: Lock-out, out of fuel, flat tire, over heat, or dead battery. One call and our elite roadside service will promptly get you back on the road. Our fleet requires specialized service and flatbed towing. Flatbed towing is required by our fleet. Serious damage will happen to our vehicles if they are not properly towed.
TOTAL TRIP PROTECTION COVERAGE: Coverage for: 100% refund if needing to cancel or prorated refund of remaining reservation for any reason. This also includes our 24/7/365 Elite Roadside Concierge. This option also waives the need for a deposit to be held for the rental. The Total Trip Protection package does NOT cover mechanical failure or property damage due to customer mis-use or negligence. You are fully responsible for your own actions while driving any vehicle in the velocity fleet.
SPECIAL OCCASION CURATION: By selecting this option you are affirming that you and no one in your party are allergic to chocolate, or grape juice.
SHUTTLE SERVICES: Following booking confirmation you will receive a phone call from Velocity to coordinate this service. One-Way and round trip: Utilizing Uber Black or Lyft Black within 1 hour of Velocity headquarters in Burnsville.
WHITE-GLOVE DELIVERY / PICKUP: Available in either delivery and pickup at you, or just delivery to you (then you return it to Velocity) There is not an option to have pickup at you only. Within 1 hour of Velocity headquarters in Burnsville.
RENTER'S LIABILITY INSURANCE & COMPREHENSIVE COLLISION DAMAGE WARRANTY (RLCCDW) - You agree to the terms within this agreement under the RLCCDW section.
YOUNG DRIVER: Allows drivers under 23 but at least 21 years of age to be an authorized driver. The driver must still provide a valid drivers license.

BREACH OF AGREEMENT. If you breach this agreement, you will be liable for all damage to, or loss of, the Vehicle caused by your breach, unless otherwise provided by law. No refunds will be issued and any deposits will not be returned.

MODIFICATIONS. No term of this agreement can be waived or modified except by a writing that we have signed. If you wish to extend the rental period, you must contact us a minimum of Three (3) hours before your rental period is over to check availability.

MISCELLANEOUS. No waiver by us of any breach of this Agreement will constitute a waiver of any additional breach or waiver of the performance of your obligations under this agreement. Unless prohibited by law, you release us from any liability for consequential special or punitive damages in connection with this rental or the reservation of a Vehicle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable. This agreement constitutes the entire Agreement between you and us. All prior representations and agreements between you and us are merged into this agreement.

ADDED RISK POLICY. You acknowledge the inherent nature and added risks of our Vehicles, being of high performance, custom and modified and older in age. Such as horse power, speed, suspension, handling, window tint, exhaust. You acknowledge the additional risks associated with such Vehicles, be it safety features and/or performance. You acknowledge and agree to not hold us liable for any damages, injuries, or any liability at all coming from these facts when renting our Vehicles.

FUEL POLICY. Minimum octane of 91 is required in all Vehicles. If the prepaid fuel option was not selected and paid for, the Vehicle must be returned with a full tank of gas.

RENTAL AGREEMENT VIOLATIONS. You agree to properly operate this Vehicle. If any of the following acts are committed, any applicable deposit will be collected and fully charged. You will be blacklisted from future rentals resulting in a lifetime ban on renting from Velocity.

It is agreed that the you shall not do or permit the following in or while using the Vehicle, including but not limited to:

Leave the Vehicle and fail to remove the keys or close and lock all doors, windows, and the trunk and the Vehicle is stolen.
No illegal or criminal acts, transporting of weapons or dangerous devices, or explosives.
No reckless driving, excessive revving, burnouts, drifting, drag, street, or track racing.
No removing parts, making modifications to the car, tampering or removing parts, tuning, flashing, mapping via OBD2 or any other means.
No alcohol, drugs or controlled substances in the Vehicle. No driving while intoxicated or under the influence of drugs, alcohol or other substances which would impair driving ability.
No illegal activity (prostitution, kid napping, theft, robbery, drugs, speeding, racing, etc...)
No subleasing, assignment, or commercial for profit use (Door Dash, Uber, Lyft, Uber eats, etc...)
No unauthorized, unlicensed or uninsured driver(s).

BINDING. By signing this agreement and taking possession of the rental vehicle, you agree to this agreement in its entirety and acknowledge that you have read it and have a copy for your records.
